Scope of application of the terms of sale

These general terms and conditions of sale apply to all sales made through the website WWW.TRICOTSRUIZ.COM. TRICOTS RUIZ, S.L. reserves the right to adapt or modify these general terms of sale and the characteristics of the services provided at any time and without prior notice. In case of modification, the terms in force on the day of the order will apply.

The identification of the user/customer for the order is made through log files stored on the server of TRICOTS RUIZ, S.L., including the storage of the user’s/customer’s IP address or any other information used to identify the user/customer.

The products displayed on the website (www.tricotsruiz.com) do not constitute a legally binding offer, but rather an online catalogue presenting the vendor's wide range of products.

Orders

By placing an order, you are submitting a purchase proposal for a product under the following terms and conditions. All orders are subject to product availability and order price confirmation.

Delivery times may vary depending on availability, and any guarantees or statements made regarding delivery times. TRICOTS RUIZ, S.L. shall not be held responsible for any possible delays caused by the shipping company or force majeure.

TRICOTS RUIZ, S.L. reserves the right to accept or reject any order without prior notice. Products remain the property of TRICOTS RUIZ, S.L. until full payment of the invoice has been made.

Shipping Costs

Shipping is free for orders placed within mainland Spain and/or the Balearic Islands when the total amount exceeds €100.00 (VAT included). For shipments to other countries, the user must always pay the shipping costs.

Product Availability

Our product and price offers are valid and in force as long as they appear on the website, within the limits of available stock. If the number of items ordered exceeds the quantity available, delivery cannot be guaranteed. TRICOTS RUIZ, S.L. reserves the right to deny delivery of a confirmed order if the goods are unavailable. If the product is unavailable, TRICOTS RUIZ, S.L. will notify the user/customer within one business day via email. If a payment has been made, the customer may choose between a refund, order cancellation, or replacement with another product.

Prices

The contractual language is Spanish. Prices are indicated in Euros, calculated without VAT and shipping costs. Prices may change at any time without prior notice, and items will be invoiced based on the rate in effect at the time the order is placed.

While we do our best to ensure all details, descriptions, and prices on this Website are accurate, errors may occur. If we discover an error in the price of a product you ordered, we will inform you as soon as possible and give you the option to confirm your order at the correct price or cancel it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and have already paid, a full refund will be issued.

The invoice amount is charged in full in a single payment per order. All orders are invoiced and charged only in Euros. Any customs or local taxes are the responsibility of the recipient.

Shipping costs are charged additionally; such additional costs are clearly displayed when applicable and are included in the “Total Cost”.

Payment

Upon receiving your order, a standard pre-authorization check is carried out on your payment card to ensure sufficient funds are available to complete the transaction. Products will not be dispatched until this pre-authorization check is completed. Your card will be charged once the payment has been processed.

In Case of Non-Payment

TRICOTS RUIZ, S.L. reserves the right to refuse the dispatch of an order or to process an order from a buyer who has not paid all or part of a previous order or with whom a payment dispute is still pending.

Product Images

Depending on the calibration of different monitors used to view the website, the colours of the products shown may vary slightly. TRICOTS RUIZ, S.L. is not responsible for any errors resulting from misinterpretation.

Buyer Acceptance

These general terms of sale and the prices are expressly approved and accepted by the buyer, who declares and acknowledges full knowledge of them and waives the right to invoke any conflicting document, especially their own general terms of purchase. The act of purchasing implies acceptance of these terms.

These terms may be modified at any time without prior notice.

Right of Withdrawal

Customers have 7 working days to exercise their right of withdrawal without the need to justify the decision and without any penalty (except for return shipping costs).

Product Delivery

The customer assumes all risk of damage/loss of the goods upon delivery. Upon delivery, TRICOTS RUIZ, S.L. is no longer liable; risk transfers to the customer. TRICOTS RUIZ, S.L. shall not be held responsible for delays caused by the shipping company or force majeure.

Immediately after delivery, products must be carefully inspected by the customer or an authorized person. Any damage or defects must be reported immediately to the seller. If damage is determined to have occurred during transport, the seller is not responsible.

If the customer refuses to accept the goods, except in the cases described below, such refusal is considered unfounded, and the customer must pay for both delivery and return costs. If the customer is unavailable at the time of delivery to the specified address, the seller is released from their obligation to deliver the goods.

If the delivered product does not match the product ordered and this can be determined by a simple inspection, the customer may request a replacement within 48 hours.

Returns

TRICOTS RUIZ, S.L. reserves the right to reject returns sent after the specified period (15 days from receipt of the goods).

Returns are only accepted in the case of defects or flaws. Due to monitor calibration, product colours may vary slightly. TRICOTS RUIZ, S.L. is not responsible for errors arising from misinterpretation. Return shipping costs are the responsibility of the customer. TRICOTS RUIZ, S.L. will not accept returns sent with postage due.

All items must be returned in their original condition, including tags and packaging. All products will be inspected upon return. Once verified by the quality department, the corresponding amount will be refunded using the same method as the original payment.

The refund will be made as soon as possible and, in any case, within 30 days of receipt of the returned items in the warehouse.

Delays in delivery by the shipping company are not grounds for return.

Applicable Law and Jurisdiction

These terms and conditions shall be interpreted in accordance with Spanish law and, in the event of any dispute or claim associated with these terms, such dispute or claim shall be subject to the exclusive jurisdiction of the Spanish courts.
